GENERAL CONDITIONS OF SALE
SUBJECT
Article 1.
The present general conditions of sale specify the rights and obligations of the buyer towards
the products sold in the electronic catalogue pahannaestore.com.
As part of a distance selling system. The contract established in the event of an effective order within
the framework of and according to the terms outlined in the current general conditions of sale.
Results from the regulations of distance selling, such as they are notably the result of the consumer code.
As well as the specific measures outlined below.

PRODUCTS
Article 3.
The products for sale are those which feature on the website pahannaestore.com on the day
that the client consults the site. Pahannaestore.com does not sell any products which are second hand,
faulty or of quality inferior to the standards offered on the market.
Some of our pieces are single originals. We draw the client's attention to the fact that the photographs
showing our products may turn out to be slightly different from reality due to the client's screen settings
and the lighting when the photos were taken.
Furthermore, as it concerns hand-crafted creations, the articles may present "finishing" irregularities,
differences in size and/or color inherent to this type of fabrication which cannot be considered to be
major defects.
The responsibility of the seller cannot be called into question; the validity of the order cannot be affected
by the above. In all eventualities, the presentation photos of the products on offer in the electronic catalogue pahannaestore.com are not contractual, and they cannot
make the seller liable to the buyer.
PRICES
Article 4.
The prices displayed are in euros, all French taxes included, excluding delivery expenses, and order
processing expenses. The price must be paid in full when placing the order.
The seller reserves the right to modify at any time the sale price which appears on the electronic catalogue,
with the exception of any product which has been sold for the price displayed on the website pahannaestore.com.
In the case of a product delivery outside of the French territory, the border crossing tariffs and formalities
are the exclusive responsibility of the client, unless otherwise specified. The client therefore promises to check the importation possibilities of ordered products in
relation to the territory of the country of delivery.
ORDERS
Article 5.
The buyer will need to identify himself or herself by filling in the order form offered by the website and follow
the instructions, after having checked the content of the order, as well as its total cost (products ordered, forwarding fees), and corrected possible errors, the buyer
will then confirm it definitively.
This confirmation is tantamount to the conclusion of the contract. Once the contract has been concluded pahannaestore.com will send a receipt of the order to the buyer,
by e-mail, containing a summary of the information registered on the order form.
The languages used to conclude the contract with pahannaestore.com are French and English.
MEANS OF PAYMENT
Article 6.
To pay the prices of the products and the forwarding fees, the buyer is to follow the terms indicated on
the order form. The payment for purchases can only be made by credit card via Paypal or bank transfer.
The buyer will need to transmit his or her bank card number, according to card type, the expiry date of
the card, as well as the security number (3 figure number which is at the back of the bank card).

The buyer guarantees to the seller, during the validation of his or he order form, that his or her situation is
legal in regard to the payment card issuer. The financial information will be transmitted, by means of an encryption protocol, to PayPal or other banks providing
services related to electronic distance payments,
without third parties being able to have access to it.
PAYMENT CONFIRMATION
Article 7.
The order will be considered valid after confirmation of the banking payment agreement.
In case of payment denial by the bank, the order will automatically be cancelled.
However, pahannaestore.com reserves the right to refuse any and all orders or deliveries in the event
of (ongoing dispute with the buyer,) buyer's total or partial non-payment of a previous order,
(credit or bank card company's refusal to authorize payment,) non-payment or partial payment.
In all these cases, pahannaestore.com cannot be held liable in any manner.
DELIVERY
Article 8.
The ordered products is delivered by post or by an
independent transporter, depending on the nature of the ordered product, and by the exclusive initiative of the seller, to the address on the order form of the buyer.
This address may differ from the address of the person who paid.
Our jewelry is mainly made in a traditional way 'by hand'. The majority of our jewelry is only made by command. Also the pieces that the buyer may wish to purchase are unlikely to be in
stock, but can be specially made at
the buyer's request.
The buyer's attention is therefore drawn to the fact that the delivery times may vary from 8 to 10 weeks depending on the time of year and the complexity of the works requested.
Pahannaestore.com delivers its products in France
and Monaco, pahannaestore.com does not deliver PO Boxes.

For all countries outside of the European Union, delivery is made on a DDU basis (delivery duty unpaid).
This means the recipient will be liable for any local sales taxes or import duties which may be charged on
the purchase.
In the event of damage, the buyer is responsible for listing all necessary objections clearly and accurately on the delivery order, a copy of which is addressed by post or by the transporter to the
buyer.
In this respect, it lies with the buyer to verify the contents, the conformity and the state of the product on
the delivery. This verification should take place once the buyer, or a person duly authorized by the buyer,
has signed the delivery order presented by the postmaster or by the transporter.
Despite the care taken in preparing orders, it may be that an error occurred during its preparation.

LOST PARCEL
Article 9.
If, within 5 working days after the application of shipping his order, the buyer has not received his parcel
(or a notice of passage, or an accurate information via the online tracking of the parcel), it must return to
his post office (for Colissimo), or contact FedEx in case of delivery by this carrier, with the tracking number available in its client account and in the confirmation
email that was sent during the development of the
shipping parcel. If the carrier has no trace of the parcel, the buyer must contact as soon as possible pahanna.com/estore’s Customer Service.
pahannaestore.com’s customer service will open an investigation with the carrier. The buyer will receive
an email explaining that an investigation was initiated and that the response times vary between 10 and 30 days after the initiation of this investigation. If the parcel
is found, it will be immediately returned to the buyer.
If the parcel is deemed lost, pahannaestore.com will refund the total amount of the order.
RIGHT OF RETRACTION
Article 10.
In accordance with the clauses of article L. I2I-20
of the consumer code, the buyer has 7 clear day deadline, including the day of delivery, to return the product to pahannaestore.com for reimbursement,
without any penalties apart from the return costs.
If this deadline of 7 days expires on a Saturday, Sunday, national holiday or day off, it is extended until
the first working day that follows. The buyer will inform pahannaestore.com by e-mail of his or her intention
to return the product, before the 7 day deadline has expired, to the following address:

Pahannaestore.com will however only accept the exchange and reimbursement of jewelry if all the conditions stipulated below are respected:
10.1.
The buyer informs the seller of his or her intention to return the
product within the deadline
outlined in the 3rd paragraph of the present article
10.2.
The product must not have been worn, jaded, changed, cleaned, or damage
10.3.
The product must be returned in its original packaging accompanied by the invoice
10.4.
The returned products are handed over by the buyer to the courier within the 7 days
following their receipt
10.5.
If the occasion arises, the security and identification Tag is still attached to the Products
(This is a white plastic Tag). This Tag is stamped “Pahanna” on the front and
has an identification
number on the back. In case of withdrawal, this Tag cannot be tied back to the product concerned.
In the event where the return of the product by the buyer is due to an error by
pahannaestore.com
such as the receipt of the wrong product (subject to article 3 of the documents herein) or a defect in the product's fabrication, pahannaestore.com promises to reimburse, in addition to the purchase
price of the product, the forwarding fees paid for by the buyer for the delivery of the product.
The buyer will need to report the error by e-mail
to
info@pahanna.com within a maximum of 48 hours
following receipt of the order.
The buyer who will have exercised his right of retraction within the conditions of the present article will be reimbursed within 30 days from the date on which
pahannaestore.com was aware of the exercising of his
or her right of retraction.
No reimbursement can take place to the benefit of the buyer who has not exercised his or her
right of
retraction within the conditions of the present article.
In this case the buyer will only be able to claim his or her expenses, on the return of the product bought
such as it will have been received before by pahannaestore.com.
The costs and risks associated with returning product are the responsibility of the buyer.
If the product is lost by the carrier during the shipment, the buyer shall be solely responsible and will
not be reimbursed by pahannaestore.com.
PRODUCTS ON SALE MAY NOT BE RETURNED OR EXCHANGED.

Article 12.
The transmission of information on the website pahannaestore.com operates within a secure context
which respects the formalities in force on the internet.
Bank card numbers are not kept on the website pahannaestore.com but on the secured website of
our banking establishment.
Pahannaestore.com promises to not divulge the information to third parties.
The information is confidential and will only be used to process the order.
In accordance with the loi informatique et liberty’s (French data protection act) of 6 January 1978,
you have the right to access, change and cancel the personal details which concern you.
In order to do this, you will need to make the request to us on line or by post, indicating you surname,
first name, address and if possible your client reference to the following address:

files and individual liberties, the processing of personal data collected on the Website has been the object
of a declaration to the French CNIL (Commission Nationale de l’Informatique et des Libertés,
or National Committee on Computerization and Individual Freedoms) under the n°1501652.
LIABILITY
Article 13.
The liability of pahannaestore.com is strictly limited to the amount of the buyer's order.
Pahannaestore.com cannot be held liable for any inconvenience or damage arising from the use
of a computer, a computer network or the Internet.
In particular, pahannaestore.com cannot be held liable for breach of service, external intrusion or presence
of a computer virus. For all stages of access to the website, including consultation, fill form, ordering, payment and any other service available on the website,
pahannaestore.com only has an obligation of means.
pahannaestore.com is not responsible for any damage, intangible or tangible caused by the malfunction
or misuse of any product purchased on the website.
FORCE MAJEURE
Article 14.
In the event of total or partial non-performance by pahannaestore.com of any one of its obligations
hereunder, pahannaestore.com shall incur no liability in connection therewith if such non-performance
is due to a force majeure event, in particular without limitation in cases of labor unrest or total strike of
postal services or shipping and/or communications companies, floods, fires, and generally any event
beyond its control.
The parties agree that they should consult each other as soon as possible in order to determine on a
mutual basis how the order should be carried out during the force majeure event.
Should the force majeure event interrupt services for longer than one (1) month, pahanna.com/estore is
entitled not fill the order, with the obligation of reimbursing the buyer, if applicable, within thirty (30) days.
APPLICABLE LAW
Article 15.
The general conditions of sale and the present contract are governed by French law.
MODIFICATIONS AND UPDATES
Article 16.
The general conditions of sale are regularly modified, notably in view of possible changes to standards.
The new general conditions of sale will apply on the date of their publication on the site pahannaestore.com.
